Drawing upon my experience over the last 40+ years as both an advocate and a mediator, in selecting a mediator you should consider the following:
To be a good mediator in civil litigation cases, ideally the mediator should have had litigation/jury trial experience. Which party they historically represented is not the critical issue – it’s the experience in the trenches that’s important. When selecting a mediator choose someone who would be influential and persuasive in BOTH caucus rooms and has the ability to accurately “read the rooms”—and most importantly, someone who has an excellent track record of getting cases settled, which includes tenacity and creativity in following up days, weeks and even months after the mediation date.
I believe I have these characteristics. Feedback from the hundreds of attorneys and adjusters with whom I have worked reinforces my belief, as well as the fact that I have a very high rate of success in my mediations.
